Abstract
A fence system and method using metal fence posts which are each assembled by attaching two elongate pieces having block Z cross-sectional shapes to form offset, longitudinally extending channels, on opposite sides of the posts, for receiving the end portions of a series of segments of fence filler material which extend between the posts.
Claims
1. A fence post comprising: an elongate first piece; an elongate second piece; each of the first and the second pieces having a block Z cross-sectional shape such that each of the first and the second pieces comprises a longitudinally extending center plate portion having a longitudinal axis, a longitudinally extending first outer edge, and a longitudinally extending second outer edge opposite the first outer edge, a longitudinally extending first flange plate which extends along and projects laterally outward in a first direction from the first outer edge of the center plate portion at substantially a 90 angle, and a longitudinally extending second flange plate which extends along and projects laterally outward in a second direction, opposite the first direction, from the second outer edge of the center plate portion at substantially a 90 angle; and the center plate portion of the second piece of the fence post being connected to the center plate portion of the first piece of the fence post to form (i) a longitudinally extending first channel, between the first flange plate of the first piece and the first flange plate of the second piece, for receiving a first fence filler material and (ii) a longitudinally extending second channel, between the second flange plate of the first piece and the second flange plate of the second piece, for receiving a second fence filler material which is identical to or different from the first fence filler material.
2. The fence post of claim 1 further comprising: the first flange plate of the first piece being parallel to the first flange plate of the second piece and the second flange plate of the first piece being parallel to the second flange plate of the second piece.

The fence post of claim 1 further comprising: the center plate portion of the first piece having a longitudinal series of bolt holes therethrough; the center plate portion of the second piece having a longitudinal series of corresponding lateral slots therethrough for adjusting (i) a width of the longitudinally extending first channel between the first flange plate of the first piece and the first flange plate of the second piece and (ii) a width of the longitudinally extending second channel between the second flange plate of the first piece and the second flange plate of the second piece; and the center plate portion of the second piece being adjustably connected to the center plate portion of the first piece by bolts which extend through the bolt holes of the first piece and the corresponding lateral slots of the second piece.

The fence post of claim 3 further comprising the lateral slots of the second piece having a length which is sufficient to adjust the width of each of the first and second channels from a minimum width of inch or less to a maximum width of inch or more, the width of the first channel being a distance from the first flange plate of the first piece to the first flange plate of the second piece and the width of the second channel being a distance from the second flange plate of the first piece to the second flange plate of the second piece.
5. The fence post of claim 1 further comprising for each of the first and the second pieces of the fence post: the first flange plate lying in a first plane; the second flange plate lying in a second plane; and the second plane being parallel to the first plane.
6. The fence post of claim 1 further comprising the second piece having a longitudinal length which is less than a longitudinal length of the first piece such that the first piece includes, but the second piece does not include, an anchoring end portion which extends into a ground surface.
7. A fence comprising: a fence post comprising an elongate first piece, an elongate second piece, each of the first and the second pieces having a block Z cross-sectional shape such that each of the first and the second pieces comprises a longitudinally extending center plate portion having a longitudinal axis, a longitudinally extending first outer edge, and a longitudinally extending second outer edge opposite the first outer edge, a longitudinally extending first flange plate which extends along and projects laterally outward in a first direction from the first outer edge of the center plate portion at substantially a 90 angle, and a longitudinally extending second flange plate which extends along and projects laterally outward in a second direction, opposite the first direction, from the second outer edge of the of the center plate portion at substantially a 90 angle, and the center plate portion of the second piece of the fence post being connected to the center plate portion of the first piece of the fence post to form (i) a longitudinally extending first channel between the first flange plate of the first piece and the first flange plate of the second piece and (ii) a longitudinally extending second channel between the second flange plate of the first piece and the second flange plate of the second piece; a first fence filler material having an end portion or a series of end portions which is/are received in the first channel; and a second fence filler material having an end portion or a series of end portions which is/are received in the second channel, the second fence filler material being identical to, or different from, the first fence filler material.
8. The fence of claim 7 further comprising: the first fence filler material comprising a vertical series of horizontal boards, planks, or panels and the second fence filler material comprising a vertical series of horizontal boards, planks, or panels.
9. The fence of claim 7 further comprising for each of the first and the second pieces of the fence post: the first flange plate lying in a first plane; the second flange plate lying in a second plane; and the second plane being parallel to the first plane.
10. The fence of claim 9 further comprising: the first flange plate of the first piece being parallel to the first flange plate of the second piece and the second flange plate of the first piece being parallel to the second flange plate of the second piece.
11. The fence of claim 7 further comprising: the center plate portion of the first piece of the fence post having a longitudinal series of bolt holes therethrough; the center plate portion of the second piece of the fence post having a longitudinal series of corresponding lateral slots therethrough for adjusting (i) a width of the longitudinally extending first channel between the first flange plate of the first piece and the first flange plate of the second piece and (ii) a width of the longitudinally extending second channel between the second flange plate of the first piece and the second flange plate of the second piece; and the center plate portion of the second piece being adjustably connected to the center plate portion of the first piece by bolts which extend through the bolt holes of the first piece and the corresponding lateral slots of the second piece.
12. The fence of claim 11 further comprising the lateral slots of the second piece having a length which is sufficient to adjust the width of each of the first and second channels from a minimum width of inch or less to a maximum width of inch or more.
13. The fence of claim 7 further comprising: a plurality of screws which extend through the first flange plate of the first piece and/or the first flange plate of the second piece into the end portion or the series of end portions of the first fence filler material and a plurality of screws which extend through the second flange plate of the first piece and/or the second flange plate of the second piece into the end portion or the series of end portions of the second fence filler material.
14. The fence of claim 7 further comprising the second piece of the fence post having a longitudinal length which is less than a longitudinal length of the first piece of the fence post such that the first piece includes, but the second piece does not include, an anchoring end portion which extends into a ground surface.
15. The fence of claim 7 further comprising: the fence post being a first fence post; a second fence post which is identical to the first fence post and includes a first piece, a second piece, a longitudinally extending first channel, and a longitudinally extending second channel which are identical to the first piece, the second piece, the longitudinally extending first channel, and the longitudinally extending second channel of the first fence post; the end portion or the series of end portions of the first fence filler material being a first end portion or a first series of end portions of the first fence filler material; and the first fence filler material further comprising a second end portion or a second series of end portions, opposite the first end portion or the first series of end portions of the first fence filler material, which is/are received in the second channel of the second fence post.
16. The fence of claim 15 further comprising, for each of the first fence post and the second fence post, the second piece having a longitudinal length which is less than a longitudinal length of the first piece such that the first piece includes, but the second piece does not include, an anchoring end portion which extends into a ground surface.
17. The fence of claim 15 further comprising: a third fence post which is identical to the first fence post and includes a first piece, a second piece, a longitudinally extending first channel, and a longitudinally extending second channel which are identical to the first piece, the second piece, the longitudinally extending first channel, and the longitudinally extending second channel of the first fence post; the end portion or the series of end portions of the second fence filler material being a second end portion or a second series of end portions of the second fence filler material; and the second fence filler material further comprising a first end portion or a first series of end portions, opposite the second end portion or the second series of end portions of the second fence filler material, which is/are received in the first channel of the third fence post.
18. The fence of claim 15 further comprising, for each of the first fence post, the second fence post, and the third fence post, the second piece having a longitudinal length which is less than a longitudinal length of the first piece such that the first piece includes, but the second piece does not include, an anchoring end portion which extends into a ground surface.

(10) As used herein and in the claims, unless otherwise stated, the term horizontal when used in reference to the fence filler material 6, or to the inventive fence system 2 or the features thereof in general, includes both (i) a substantially non-angled horizontal orientation (i.e., 10) or (ii) a horizontal orientation which is otherwise angled to a degree needed to adapt to the slope of the terrain.
(11) The fence filler material 6 used in the inventive fence system 2 can be generally any type of fencing material used in the art to provide the body of the fence 2 which fills the horizontal segments between the fence posts 4a, 4b, 4c. Moreover, because of the adjustability of the widths of the longitudinally extending first and second channels 30 and 32 (discussed below) of the fence post assemblies 4 for receiving and holding, or clamping, the filler materials 6, the thickness of the filler material 6 can range from 0.4 inch or less to 0.75 inch or more (more preferably from 0.5 inch or less up to 0.8 inch or 0.85 inch or 0.9 inch or 0.95 inch or 1.0 inch or more).
(12) By way of example, but not by way of limitation, examples of fence filler materials 6 preferred for use in the inventive fence system 2 include (i) a vertical series of horizontal boards, planks, or panels 12, (ii) a woven fence or other screening material, or (iii) welded wire panels. If the segment 8 or 10 of fence filler material 6 is a vertical series of horizontal boards, planks, or panels 12 positioned one on top of the other, the boards, planks, or panels 12 can be (i) closely grouped together such that there are essentially no gaps between the horizontal boards, planks, or panels 12 or (i) spaced apart to produce a vertical series of horizontal gaps between the horizontal boards, planks, or panels 12.

(14) Because of their block Z cross-sectional shapes as illustrated in the drawings, each of first elongate piece 14 of the post 4 and the second elongate piece 16 of the post 4 comprises: (a) a flat, longitudinally extending center plate portion 18; (b) a flat, longitudinally extending first flange plate 26; and (c) a flat, longitudinally extending second flange plate 28.
(15) The center plate portion 18 of each of the first and second elongate pieces 14 and 16 of the post 4 has a longitudinal axis 20, a longitudinally extending first outer edge 22, and a longitudinally extending second outer edge opposite 24 the first outer edge 22. The first flange plate 26 of each of the first and second elongate pieces 14 and 16 extends along and projects laterally outward in a first direction from the first outer edge 22 of the center plate portion 18 at substantially a 90 angle (i.e., 905). The second flange plate 28 of each of the first and second elongate pieces 14 and 16 extends along and projects laterally outward in a second direction, opposite the first direction, from the second outer edge 24 of the center plate portion 18 at substantially a 90 angle. Most preferably, the first flange plate 26 of each post member 14 and 16 lies in a first plane, the second flange plate 28 lies in a second plane which is offset from the first plane, and the second plane is parallel to the first plane.
(16) In the inventive fence post assembly 4, the center plate portion 18 of the second elongate piece 16 of the post 4 is positioned against and connected to the center plate portion 18 of the first elongate piece 14 to form (i) a longitudinally extending first channel 30, between the first flange plate 26 of the first piece 14 and the first flange plate 26 of the second piece 16, for receiving an end portion (or a series of end portions in the case of, e.g., a vertical series of horizontal boards, planks, or panels 12) of a first horizontal segment 8 of fence filler material 6 and (ii) a longitudinally extending second channel 32, between the second flange plate 28 of the first piece 14 and the second flange plate 28 of the second piece 16, for receiving an end portion (or a series of end portions in the case of, e.g., a vertical series of horizontal boards, planks, or panels 12) of a second horizontal segment 10 of fence filler material 6 which may be the same as, or different from, the first segment 8 of fence filler material 6.
(17) When the second elongate piece 16 of the post 4 is connected to the first elongate piece 14 in this manner, the first flange plate 26 of the first piece 14 will preferably be parallel to the first flange plate 26 of the second piece 14 and the second flange plate 28 of the first piece 14 will preferably be parallel to the second flange plate 28 of the second piece 16. In addition, the longitudinally extending first and second channels 30 and 32 of the inventive fence post 4 are forwardly and rearwardly offset from each other so that each succeeding horizontal segment 8 or 10 of fence filler material 6 will be forwardly or rearwardly offset from the previous segment 8 or 10 of fence filler material 6.
(18) The longitudinally extending first and second channels 30 and 32 of the inventive fence post 4 preferably have a width which is adjustable for receiving and holding filler materials of different thicknesses. To provide for the simultaneous adjustment of the width of the first channel 30 and the second channel 32, the inventive fence post assembly 4 preferably further comprises: (i) a longitudinal series of bolt holes 38 formed through the center plate portion 18 of the first elongate piece 14 of the post 4; (ii) a longitudinal series of corresponding lateral slots 40 formed through the center plate portion 18 of the second elongate piece 16 which align with the bolt holes 38; (iii) a series of bolts 42 which extend through the aligned bolt holes 38 and lateral slots 40; and (iv) nuts 44 for securing the bolts 42 in the lateral slots 40 to set the desired width of the first and second channels 30 and 32 of the post 4.
(19) The distance over which the width of the first and second channels 30 and 32 of the post 4 can be adjusted depends upon the length of the lateral slots 40. In order to (a) provide a sufficient minimum width of the first and second channels 30 and 32 for receiving a filler material 6 and (b) allow the formation of lateral adjustment slots 40 of sufficient length to permit the width of the first and second channels 30 and 32 to be increased over a desired range, the width 46 of the center plate portion 18 of each of the first and second pieces 14 of the inventive post 4 will preferably be greater than the corresponding width of a typical one-piece metal Z-post which is currently available in the market.
(20) The length of the lateral slots 40 formed in the second elongate piece 16 of the inventive post 4 will preferably be sufficient to allow the width of the first and second channels 30 and 32 to be adjusted from a minimum width that is equal to or less than inch to a maximum width that is equal to or greater than inch. The length of the lateral slots 40 formed in second elongate piece 16 of the post 4 will more preferably be sufficient to allow the width of the first and second channels 30 and 32 to be adjusted from a minimum width that is equal to or less than inch to a maximum width that is equal to or greater than inch.
(21) It will be understood, however, that (i) the elongate first and second pieces 14 and 16 of the inventive fence post 4 can alternatively be adjustably attached using other techniques or (ii) the elongate first and second pieces 14 and 16 of the post 4 can alternatively be permanently attached, e.g., by welding, such that the width of the elongate first and second channels 30 and 32 of the inventive post 4 for receiving the filler material 6 is not adjustable.
(22) The longitudinal length of the second elongate piece 16 of the inventive fence post assembly 4 can be the same as or different from the length of the first piece 14. More preferably, the longitudinal length of one of the first or second elongate pieces 14 or 16 (e.g., the second piece 16) will be less than the longitudinal length of the other elongate piece 14 or 16 (e.g., the first piece 14) such that the longer piece 14 or 16 includes, but the shorter piece 14 or 15 does not include, a lower anchoring segment which extends into the ground surface 5. Consequently, the shorter piece 14 or 16 of the post 4 will preferably only extend along all or a portion of the above-ground height of the inventive fence post 4 so that the shorter piece 14 or 16 preferably does not extend into the ground 5, or preferably at least does not extend into the ground 5 to any significant length.
(23) If desired, some, most, or all of the end portions of the vertical series of horizontal boards, planks, or panels 12 of the segments 8 and 10 of the filler material 6 can simply be rest in the first and second channels 30 and 30 of the inventive post 4 without further attachment. Alternatively, in order to further secure the ends or the vertical series of ends of the filler material 6 in the post channels 30 and 32, the inventive fence post assembly 4 can further comprise: (a) a plurality of screws 48 which extend through apertures provided in the first flange plate 26 of the first piece 14 of the post 4 and/or through the first flange plate 26 of the second piece 16 of the post 4 into the end portion or the series of end portions 50 of the horizontal segment 8 of the fence filler material 6 and (b) a plurality of screws 52 which extend through apertures provided in the second flange plate 28 of the first piece 16 of the post 4 and/or through the second flange plate 28 of the second piece 16 of the post 4 into the end portion or the series of end portions 54 of the horizontal segment 10 of the fence filler material 6.
